Houellebecq and Alastair Scott

I reported the acquittal of Michel Houellebecq by a Paris court, yesterday. He was charged with 'insulting Islam'.

A similar case took place in the UK recently This is the only reference I have been able to find to the case, under the BBC’s ‘Sunday’ programme on 20th October:
Religious hatred law

Alastair Scott, who's thirty three and lives in Exeter is due to be sentenced next week [i.e. this week - Josh] in the first successful prosecution under the religious hatred laws the government brought in after September 11th.
Does this indicate a fault in the UK legislation?
